TERMS OF USAGE APPLICABLE FOR ALL INTERFACES OF ‘DASHPOD’ AND BLAZETRACK PRIVATE LIMITED (MOBILE APPLICATIONS, DIGITAL MEDIUMS, SOCIAL WEBSITES, PARTNER WEBSITES AND ONLINE/OFFLINE PRESENCE AND APPLICATIONS, ‘DASHPOD’ AND OTHER COMPANY OWNED WEBSITES AND OFFLINE CENTERS/PRESENCE) – (HEREBY COLLECTIVELY REFERRED TO AS ‘DASHPOD INTERFACES’ OR ‘DASHPOD’ OR ‘WE’).

‘Dashpod’ is an electronic battery driven device(s) which works on Bluetooth technology and connects to a mobile application for its functionality, while seeking to improve fitness and agility building, the outcome of which may differ from person to person and at varying levels for the same person at varied times.

TThe usage of any and all of the ‘Dashpod Interfaces’ at any point of time, warrants your acceptance of the usage terms in this document, the clauses of which can change from time to time, due to any updates operational or regulatory requirements. By accessing, shopping and ordering on ‘‘Dashpod’ Interfaces’, you indicate your unconditional acceptance of these terms & conditions. We reserve this right, in our sole discretion, to update or revise these terms & conditions. Continued use of the site following the posting of any changes to the ‘terms & conditions’, constitutes your acceptance of those changes.

Use of the Site is available only to persons who can legally enter into contracts under applicable laws. Persons who are "incompetent to contract", within the meaning of the Indian Contract Act, 1872 including un-discharged insolvents etc. are not eligible to use ‘‘Dashpod’ Interfaces’. ‘‘Dashpod’’ and related entities reserve the right to terminate your access to the ‘‘Dashpod’ Interfaces’, if it discovers that you are under the age of 18 years or suffers from any other disability, as recognized under Indian Contract Act, 1872. The jurisdiction of all disputes related to ‘‘Dashpod’ Interfaces’ and its order / fulfilment related disputes will be Hyderabad, Telangana, India

It is required to register with us with the required information to be able to access ‘‘Dashpod’ Interfaces’. As a registered member, you agree to provide true, accurate, current, and complete information about yourself as prompted by the site's registration form. Registration where prohibited under any law shall be void. ‘Dashpod Interfaces’ reserves the right to revoke or terminate your registration for any reason at any time, without notice.

Reviews, Feedback, Submissions:

All reviews, comments, feedback, postcards, suggestions, ideas, and other submissions disclosed, submitted or offered to ‘‘Dashpod’ Interfaces’ directly or otherwise disclosed, submitted, or offered in connection with your use of this ‘‘Dashpod’ Interfaces’ (collectively referred to "Comments") will remain ‘‘Dashpod’ Interfaces’ property. Such disclosure, submission or offer of any comments shall constitute an assignment to ‘‘Dashpod’ Interfaces’ of all worldwide rights, titles and interests in all copyrights and other intellectual properties in the comments, thus, it exclusively owns all such rights, titles and interests and shall not be limited in any way in its use, commercial or otherwise. ‘‘Dashpod’ Interfaces’ will be entitled to use, reproduce, disclose, modify, adapt, create derivative works from, publish, display and distribute any comments you submit for any purpose whatsoever, without restriction and without compensating you in any way. ‘‘Dashpod’ Interfaces’ is and shall be under no obligation (1) to maintain any Comments in confidence; or (2) to pay you any compensation for any Comments; or (3) to respond to any Comments. You agree that any comments submitted by you to the Site will not violate this policy or any right of any third party, including copyright, trademark, privacy or other personal or proprietary right(s), and will not cause injury to any person or entity. ‘‘Dashpod’ Interfaces’ does not regularly review posted comments but does reserve the right (but not the obligation) to monitor and edit or remove any comment submitted to the Site or any of the ‘Dashpod interfaces’. You grant ‘‘Dashpod’ Interfaces’ the right to use the name that you submit in connection with any of the posted comments. You agree not to use a false email address, impersonate any person or entity, or otherwise mislead as to the origin of any Comments you submit. You are and shall remain solely responsible for the content of any comments (Source of Images, text, slogans and comments you make, and you agree to completely indemnify ‘‘Dashpod’ Interfaces’ and its affiliates for all claims resulting from any Comments you submit, we take no responsibility and assume no liability for any comments submitted by you or any third party whatsoever and at any point of time.

Accuracy of Content/ Information of Products on the ‘‘Dashpod’ Interfaces’:

While ‘‘Dashpod’ Interfaces’ strives to provide accurate product and pricing information, typographical errors may occur. In the event that a product is listed at an incorrect price or with incorrect information due to an error in pricing or product information, ‘‘Dashpod’ Interfaces’ shall have the right, on our sole discretion, to modify the same, unless the product has already been dispatched.

Alterations or Quality Error Request:
COVID 19 and other emergency situations:

As the COVID 19 pandemic (or any future contingencies/pandemics) continues, Govt. of India has announced extensive lockdown and restrictions to certain parts of country, owing to which production and Shipping of all orders will start after the lockdown opens. Your orders are safe with us and we will be working towards fulfilling them in the meantime, so keep them coming! Stay Safe. Stay Inside. The coverage of lockdowns to pincodes / zipcodes in India and abroad will affect our serviceability and we request your support and continued patronage.

Use of Gift Coupons and Gift Cards/Vouchers:

Please note that we may be using the services of a third-party provider for issuing Gift Coupons and Gift Cards. Hence the service availability for issuance and redemption will depend on the service parameters of such partners. Please reach out to us for any issues faced during the use of Gift cards and we will take up the matter with the service provider.

Cancellation Policy:

Please note that an order cannot be refunded if:
1. Any of the components have been used, scratched, or defaced OR
2. Any of the components have been tampered with OR
3. Any of the items / components are missing or disfigured.

Payment for Online Orders and Shopping through ‘‘Dashpod’ Interfaces’:

‘Dashpod’ Interfaces’ offer you multiple payment methods to make your purchase by using options such as Visa, MasterCard and Rupay credit/debit cards, UPI, Net banking options in India and other countries, through its selected government approved third-party payment gateways or payment processors. The availability of the services of such payment gateways in all countries is a matter of operational policy of the respective payment gateway company and ‘Dashpod Interfaces’ cannot be held responsible for the same at any point of time.

You can be rest assured that ‘‘Dashpod’ Interfaces’ trusted payment gateway partners use best possible secure encryption technology to keep your transaction details confidential at all times. We only have access to the interfaces and the related data shared by our payment gateway providers. We DO NOT host or save any of your card / account details on our systems UNLESS the payment gateway / payment processor’s systems / process sends the same to us.

All payments made against the purchases/services on ‘‘Dashpod’ Interfaces’ by you shall be compulsorily in Indian Rupees acceptable in the Republic of India. In case of overseas remittances, the applicable foreign exchange rules, all applicable processing charges and regulations will apply.

Before shipping / delivering your order to you, ‘‘Dashpod’ Interfaces’ or its authorized staff / consultants / personnel may request you to provide supporting documents (including but not limited to Govt. issued ID and address proof) to establish the ownership of the payment instrument used by you for your purchase. This is done in the interest of providing a safe online shopping environment to our users.

Credit/Debit Card/ Net Banking Details:

You agree, understand and confirm that the Credit/Debit card/Net banking/UPI details provided by you for purchase of products on ‘‘Dashpod’ Interfaces’ will be correct and accurate, and you shall not use the credit/debit card/net banking which is not lawfully owned by you. You further agree and undertake to provide the correct and valid credit/debit card/ net banking details when making payment on ‘‘Dashpod’ Interfaces’. Your credit/debit card/ net banking information never reaches ‘‘Dashpod’ Interfaces’, we just get pass, hold or fail message from our payment gateways. The said information will not be utilized and shared by our payment gateways or ‘‘Dashpod’ Interfaces’ unless required for fraud verifications or by law, regulation or court order. ‘‘Dashpod’ Interfaces’ will not be liable for any credit/debit card/ net banking fraud. The liability for use of a card/net banking fraudulently will be on you and the onus to 'prove otherwise' shall be exclusively on you.

Fraudulent / Incomplete / Declined Transactions:

Payments for orders can be made through our Online payment methods such as UPI modes, and Online Payment Gateways only. We encourage all payments to be made using digital mediums. No other modes of payment are acceptable at any point of time. You undertake to remit the complete payments due to ‘‘Dashpod’ Interfaces’ as per the order value agreed while confirming the order. We reserve the right to recover the cost of goods, collection charges and legal expenses from persons using the ‘‘Dashpod’ Interfaces’ fraudulently/mischievously; ‘‘Dashpod’ Interfaces’ reserves the right to initiate legal proceedings against such persons for fraudulent/mischievous use of the ‘‘Dashpod’ Interfaces’ and any other unlawful acts or acts or omissions in breach of these terms and conditions.

We, as a merchant shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly due to decline or authorization for any Transaction.
