WARRANTY TERMS APPLICABLE (AUTHORIZED DIGITAL MEDIUMS, AUTHORIZED PARTNER WEBSITES, AUTHORIZED RELATED OFFLINE AND ONLINE PRESENCE, ‘DASHPOD’ AND OTHER COMPANY OWNED WEBSITES AND OFFLINE ORDER CENTERS) – (HEREBY REFERRED TO AS ‘WE’ OR ‘DASHPOD’ OR ‘SELLER’ OR ‘BLAZETRACK PRIVATE LIMITED’)

‘Dashpod’ is an electronic battery driven device(s) which works on Bluetooth technology and connects to a mobile application for its functionality, while seeking to improve fitness and agility building, the outcome of which may differ from person to person and at varying levels for the same person at varied times.

The usage of any and all of the ‘Dashpod Interfaces’ at any point of time, warrants your acceptance of the warranty terms in this document, the clauses of which can change from time to time, due to any updates operational or regulatory requirements.

ORIGINAL PURCHASES ONLY:

Blazetrack Private Limited (hereinafter referred to as ‘Seller’) warranties extend to authorized dealers / Authorized Online seller(s) / Authorized Online Selling Portal(s) / Authorized Offline entitie(s) only. No warranty offered by Seller is transferable. Seller specifically disclaims any warranty to any party who did not directly purchase from Seller.

The duration of the warranty shall be 12 months from the date of the purchase of the device(s) / dashpod(s).

WARRANTY COVERS NORMAL USE ONLY:

Each of Blazetrack Private Limited warranties covers defects arising under normal and expected / intended use only and DO NOT include malfunctions or failures resulting from misuse, abuse, submerging in water / use in rains / exposure to extreme dusty environments, drop for a height, neglect, alteration, problems with electrical power during charging of the devices, usage not in accordance with product instructions, acts of nature or improper installation or repairs.

WARRANTY REQUIREMENTS:

• Warranty coverage requires proof of purchase documentation (Invoice).
• All warranty cleared returns must be clearly marked with the Invoice number and the copy of the Invoice will need to be placed inside the box/packaging. The Invoice number can be marked on the outside of the package for identification. Returns will not be accepted unless so marked.
• Goods must be returned properly packaged in their original shipping container or in an equivalent, ESD safe container.
• Goods must be returned with adequate packaging to ensure that they are not damaged in transit.
• Legacy disclaims any responsibility for goods packaged in such a way that they are likely to be damaged in transit.
• Modification to or tampering with the product/devices including any labels, stickers or markings of any kind shall immediately void the applicable warranty.

NO MODIFICATION OF WARRANTY:

No reseller, agent, or employee is authorized to make any modification, extension, or addition to any warranty at any point of time. The latest copy of the warranty can be found on our website: www.dashpod.in

WHO MAKES THE DETERMINATION OF CAUSE?

Seller shall make the final determination as to the existence and cause of any defect.

WHO PAYS FOR SHIPPING AND BEARS RISK OF LOSS?

The customer is responsible for all shipping costs, including freight insurance for goods shipped to Seller. If Seller elects to repair or replace goods deemed to be within warranty, Seller shall pay shipping costs, including freight insurance. If goods are deemed to be outside of warranty they will be returned to the customer at the customer’s expense and at the customer’s own risk. Seller is not responsible for damage to goods out of warranty incurred in transit as our shipping terms are FOB Canton, SD.

MODIFICATION TO HARDWARE AND SOFTWARE:

Seller reserves the right to make modifications to both hardware and software without prior notification.

COUNTERFEIT MODULES:

Seller will not repair or replace any product that we determine was not manufactured by seller (counterfeit modules).

BUYERS REMEDY:

For any claim made under warranty, Buyer’s exclusive remedy shall be limited, at the Seller’s election, to repair or replace the defective Products, or refund of the purchase price thereof, or crediting of the same against future purchases by Buyer at the original purchase price or fair market value, whichever is lower.

SOLE WARRANTY:

No product sold by seller is authorized for use as critical components in life support devices or systems.

This warranty is in lieu of any other warranties, either express or implied, including without limitation any warranties of Merchantability or Fitness for a particular purpose or title against infringement, which other warranties are expressly excluded and disclaimed.

SELLER SHALL IN NO EVENT BE LIABLE TO BUYER OR ANY THIRD PARTY FOR ANY CONSEQUENTIAL, INDIRECT, OR INCIDENTAL DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOSS OF PROFITS, LOSS OF BUSINESS INVESTMENT, LOSS OF GOODWILL, AND/OR INTERFERENCE WITH BUSINESS RELATIONSHIPS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. LEGACY SHALL NOT BE LIABLE IN THE EVENT THAT THE PRODUCTS OR ANY DEFECT THEREIN CAUSE ANY DAMAGE TO OR FAILURE OF OTHER EQUIPMENT. THE FOREGOING LIMITATION OF LIABILITY SHALL NOT APPLY TO THE EXTENT THAT IT IS ILLEGAL OR UNENFORCEABLE UNDER APPLICABLE LAW.

In no event shall seller’s liability exceed the purchase price of the defective product.

NON-ASSIGNABILITY OF WARRANTY:

THIS WARRANTY IS THE ONLY WARRANTY MADE BY SELLER WITH RESPECT TO THE PRODUCTS. THERE ARE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND BY THE SELLER OR ANY PERSON WHO IS AN AGENT, EMPLOYEE, OR OTHER REPRESENTATIVE OF SELLER, EXPRESS OR IMPLIED, WITH RESPECT TO THE CONDITION OR PERFORMANCE OF THE PRODUCTS, INCLUDING BUT NOT LIMITED TO THEIR MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
